For the purposes of interpretation of this Disclaimer and Conditions of use for Relevate Reference, the following terms will have the meaning attributed to them below:

• RELEVATE REFERENCE: the digital platform owned by the Randstad Group designed to obtain employment and professional references from the users of RELEVATE REFERENCE.
• User and/or Candidate:
  • Randstad candidate user: Randstad candidates taking part in a personnel selection process conducted by Randstad, for the purpose of obtaining employment and professional references from the referee via RELEVATE REFERENCE.
  • Randstad client candidate user: Randstad client candidates taking part in a personnel selection process conducted by Randstad, for the purpose of obtaining employment and professional references from the referee via RELEVATE REFERENCE. Randstad candidate Users and Randstad client candidate Users may be jointly referred to as Users and individually as Randstad candidate User or Randstad client candidate User.
• Referee: person with whom the candidate has worked and who is familiar with their professional development and who the candidate has indicated as referee; the referee accesses RELEVATE REFERENCE to fill in the questionnaires existing for obtaining the candidate's employment and professional references.
• Randstad: the company or entity linked to the Randstad Group which is carrying out a personnel selection process and has contacted the User in order to propose referees and fill in the RELEVATE REFERENCE questionnaires.
• Services: obtaining employment and professional references on candidates via RELEVATE REFERENCE.
• Website: collection of electronic pages hosted under the “randstad.es” domain.
• Randstad App: any computer application developed by Randstad for mobile telephones or devices.
• RELEVATE REFERENCE URL Platform: URL address for access to RELEVATE REFERENCE existing at any given time.

This Disclaimer and Conditions of Use for RELEVANTE REFERENCE establishes the terms and conditions for access to and use of RELEVANTE REFERENCE. RELEVATE REFERENCE offers the service of obtaining professional references that will facilitate job seeking and access to the labour market for Candidates; this service is free of charge unless expressly specified otherwise, in which case you will have to accept the corresponding particular conditions prior to provision thereof.

 

Access to and use of RELEVANTE REFERENCE grants you User or Referee status, as the case may be, which implies your acceptance and undertaking to comply with each and every one of the conditions contained in this Disclaimer and Conditions of Use for RELEVANTE REFERENCE in the version published at the moment of access. The Randstad Group reserves the right to amend, at any time, without the need for notice, all or part of this Disclaimer and Conditions of Use for RELEVANTE REFERENCE and the services it contains.  The valid Disclaimer and Conditions of Use for RELEVANTE REFERENCE will be the one published at any given time. Each User or Referee will be exclusively responsible for consulting the content in order to ascertain the up-to-date version of the same each time they access.

RELEVATE REFERENCE can be accessed via the Randstad Website, App or by direct access to the RELEVATE REFERENCE platform via URL.

 

RELEVATE REFERENCE can only be used correctly if the technical specifications for which it has been designed are fulfilled. Each User or Referee is exclusively responsible for their access to RELEVANTE REFERENCE, ensuring that they use it and its services in a lawful manner in accordance with this Disclaimer and Conditions of Use for RELEVANTE REFERENCE and the legislation in force. The Randstad Group will not be liable for any damage caused to the User or Referee due to inappropriate use of RELEVATE REFERENCE. In any event, the following actions are prohibited:

 

• Using RELEVATE REFERENCE and/or its content for unlawful or illegal purposes or for any purposes contrary to those established in this Disclaimer, contrary to good faith and public policy, in a manner that is injurious to the rights and interests of Randstad or third parties, or that could in any way harm, disable or overload RELEVATE REFERENCE or prevent its normal use (the use of mechanisms, software or scripts in relation to the use of RELEVANTE REFERENCE is expressly prohibited as is copying using “Robot/Crawler” search technologies).
• Using RELEVATE REFERENCE in an unauthorised or fraudulent manner and accessing or attempting to access its restricted resources.
• Causing harm to RELEVATE REFERENCE or the systems of Randstad or third parties.
• Reproducing or copying, distributing, permitting public access via any form of public communication, transforming or modifying the contents of RELEVATE REFERENCE.
• Incorporating any kind of data or valuations in the application that infringe the ownership rights of third parties, are obscene, pornographic, defamatory, threatening or constitute material that could be considered criminal by virtue of the Criminal Code in force.

Any User or Referee performing these actions or any other that could harm the rights of Randstad or of third parties will be held liable for the damage caused.

Any natural person with full powers to transact can register as a User, signing the Conditions set out in this Disclaimer.

 

In the case of unemancipated minors, in order to use RELEVATE REFERENCE they will have to be at least sixteen (16) years of age and obtain the prior authorisation of their parents, guardians or legal representatives. The Randstad Group reserves the right to request verification of the above at any time.

 

In order to access the services that the Randstad Group places at your disposal as a User via the Randstad App, you must install the version that is compatible with your mobile device at any given time. The Randstad Group does not guarantee the availability of the Randstad App for all operating systems.

 

Your registration as a User implies that you have read and accepted the Conditions contained in this Disclaimer and Conditions of Use for RELEVANTE REFERENCE (the version published at the time you register) and that you have expressly and accepted them without reservation, being able to store and review them when you need to.

1. If you are a Randstad client candidate User, you have to register in RELEVATE REFERENCE with an email as identifier and the password you choose (the Codes). You will receive a message in the email address indicated, so that you can verify the email address and validate the registration process. In the event you fail to complete the verification cycle using the message received via email, your registration as a User will not be processed. Once the registration is processed, the Codes generated will enable you to access RELEVATE REFERENCE. You can modify your Codes using the tools at your disposal in RELEVATE REFERENCE.
2. If you are a Randstad candidate User, you can access RELEVATE REFERENCE with the identifier and password (the Codes) you have in order to access the Randstad Website/App. You can modify your Codes using the tools at your disposal on the Randstad Website/App.

As a User, you can fill in your professional references and request references on your professional development in previous jobs from the Referees.

The Codes supplied in the registration process are personal and non-transferable, meaning that you undertake to use them diligently, adopting all reasonable measures in order to protect them, and the Randstad Group will not assume any liability in the event you share and/or supply these Codes to third parties. In the event of loss, theft or unauthorised use of the Codes, you must inform Randstad without delay, so that we can adopt the necessary measures.

 

In the event of loss or theft of your Codes, the Randstad Group will supply you with new Codes if you so request.

 

The Randstad Group assumes, unless you notify a loss, theft or unauthorised use, that accesses using the Codes are performed by you.

All the information you supply to us must be true; in this regard, you warrant the authenticity of all information and data supplied as a result of filling in the forms included in RELEVATE REFERENCE, including the data corresponding to the Referees you provide.

 

In any event, you will be the only person responsible for any false or inaccurate representations or data you make or supply and for any damage caused to the Randstad Group or third parties by the information and data supplied.

 

Randstad reserves the right to deny or withdraw your access to RELEVANTE REFERENCE at any time and without the need for prior notice, in the event you fail to comply with the terms of this Disclaimer and Conditions of Use for RELEVANTE REFERENCE.

 

Moreover, the Randstad Group reserves the right to de-register you as a User and/or Candidate in the event of inappropriate conduct on your part with respect to the Randstad Group, its personnel, the Referees, its offices and material assets and/or the clients of the Randstad Group.

The candidate, through RELEVATE REFERENCE, fills in your contact details as a Referee, in which case you will receive an invitation to access RELEVATE REFERENCE via email; once you have accessed you will be able to fill in the questionnaires in order to obtain employment and professional references on the candidate.

 

Access to RELEVANTE REFERENCE as a Referee implies that you have read and accepted the Conditions contained in this Disclaimer and Conditions of Use for RELEVANTE REFERENCE (the version published at the time you register) and that you have expressly accepted them without reservation, being able to store and review them when you need to.

 

All the information you supply to us must be true; in this regard, you warrant the authenticity of all information and data supplied as a result of filling in the forms included in RELEVATE REFERENCE.

 

In any event, you will be the only person responsible for any false or inaccurate representations or data you make or supply and for any damage caused to the Candidate, the Randstad Group or third parties by the information and data supplied.

The Randstad Group is not liable for and does not guarantee that access to RELEVATE REFERENCE will be uninterrupted or error-free. RELEVATE REFERENCE is made available “as is” (in the state in which it is and when it is available). The Randstad Group will not be liable for any telecommunications crashes, interruptions, faults or defects that may occur while the User or Referee is using it.

 

Neither the Randstad Group nor any other party involved in the creation, production or development of RELEVATE REFERENCE will be liable for any kind of damage or harm, direct, indirect or of any other kind, caused by access to or use or examination of RELEVATE REFERENCE as a result of a transfer of any file, data, text, image, video and/or audio, contained in RELEVATE REFERENCE by a User or referee to its equipment, including but not limited to, the loss of good commercial reputation, lost data, or any other harm or loss resulting from mistakes, omissions, interruptions, deleted files, errors, defects, virus, delays in operation or transmission, or any operating fault, communication fault, theft, destruction or unauthorised access to Randstad’s records, programmes or services.

 

Likewise, the Randstad Group will not assume any liability for loss or damage due to events that were unforeseeable or, if foreseen, were inevitable due to fortuitous events or force majeure.

RELEVATE REFERENCE, its source code, algorithms and the content it holds, including the questionnaires and any text, data, logos, trade names, brands and other distinctive signs, denominations, images, sounds and other resources, are protected by the current legislation governing intellectual property rights and cannot be exploited, reproduced, distributed, modified, publicly released, assigned or transformed by third parties, without the express, prior authorisation of the Randstad Group in writing. It is expressly prohibited, without the prior written authorisation of the Randstad Group, to disseminate any RELEVATE REFERENCE content by inclusion of all or part thereof on the internet, intranets, in email or by any other means, whether written, audiovisual or digital, even if the source is acknowledged.

 

Downloading and printing RELEVATE REFERENCE content is strictly prohibited. Access to RELEVATE REFERENCE does not grant the User or Referee any kind of rights over or ownership of any intellectual property rights or its content. The alteration of the content or structure of RELEVATE REFERENCE by the User or Referee is strictly prohibited. The Randstad Group reserves the right to take legal action against any User or Referee who violates or infringes these intellectual property rights.

Phishing and other fraudulent forms of theft and identity theft involve third persons posing as employees or simulating the identity of an entity by fraudulent use of email to obtain your personal data by deceit. We ask that you keep the following advice in mind:

 

• The Randstad Group will only communicate with you via email with the format “...@randstad.es”. You should therefore mistrust any other electronic communication sent in the name of the Randstad Group from a different domain to the one indicated.
• The Randstad Group will never ask you, via telephone or email, for your personal access code, in order to access RELEVATE REFERENCE. In this regard, we remind you that your user name and password are for personal use alone and are strictly confidential.
• You should not access RELEVATE REFERENCE via links other than those supplied in an email from Randstad.
• In the event of doubts regarding the authenticity of any message or communication received in the name of the Randstad Group, please contact the Randstad Group via the following email seguridad.it@randstad.es.

In the event that one or more of the conditions established in this Disclaimer and Conditions of Use for RELEVANTE REFERENCE were declared null or void, it will be considered cancelled and will not affect the rest of conditions, which will, in any event, complement and be interpreted with each other to cover any regulatory vacuum left by the conditions declared null and void.

To ensure effective equality of men and women, all terms which, due to economy of language, are in masculine form, referring to owners or members of bodies or collectives of persons, will be understood as referring to the female as well as the male form.

The use of RELEVANTE REFERENCE and the legal consequences that may derive from it, will be governed and interpreted in accordance with the content of this Disclaimer and Conditions of Use for RELEVANTE REFERENCE, which will be regulated and interpreted in line with the Spanish Civil Code and other applicable Spanish legislation. Any dispute arising in relation to the access or use of RELEVATE REFERENCE and its content will be submitted to the exclusive jurisdiction and competence of the Courts and Tribunals of Madrid (Spain).
