For the purposes of the interpretation of this Legal Notice, the following terms have the meanings attributed to them below:
- Website: the set of electronic pages hosted under the domain “randstad.es”, or any other domain under the control or ownership of the Randstad Group.
- Randstad App: any software application developed by Randstad for mobile phones or mobile devices.
- User: any natural person or legal entity that visits the Website or installs and/or uses a Randstad App.
- Randstad: Randstad España, S.L.U.
- Legal Notice: these terms and conditions.
- Services: the services offered and provided by Randstad on the Randstad Website, on the Randstad App or through any other domain under the control or ownership of the Randstad Group.

purpose
This Legal Notice establishes the conditions for access to and use of the Website/Randstad App. By accessing and using it, you become a User, which means you adhere to and undertake to comply with each and every one of the conditions contained in this Legal Notice in the version published at the moment of access.
Randstad reserves the rights to amend at any time and without the need to give advance warning, all or part of the conditions of use of the Website/RandstadApp, and these will take effect from the moment of its publication. The conditions of use in force will be those published in this Legal Notice at any given time. Each User will be solely responsible for checking the content of the same in order to be familiar with the updated version every time they access. Randstad may unilaterally modify the terms and conditions of use of this Website/Randstad App by publishing them in this Legal Notice.
The current Spanish version of these Terms of Use is incorporated in Act number 2084 of the year 2020 in the records of Mr Ricardo Vilas de Escauriaza, Notary Public of the College of Notaries of Madrid.

browsing, installation and use
The Website/Randstad App can only be used correctly if the technical specifications for which it has been designed are met. The access to this Website/Randstad App is the exclusive responsibility of the User, who will use it and its services lawfully in accordance with this Legal Notice and the legislation in force. Randstad will not be responsible for any damages caused to Users due to improper use of the Website/Randstad App.
The following actions are prohibited in any event:
- Using the Website/Randstad App and/or its content for purposes or effects that are unlawful, illegal, or contrary to the terms of this Legal Notice, to good faith and to public order, harmful to the rights and interest of Randstad or third parties, or that can in any way damage, disable or overload the Website/Randstad App or prevent the normal use of the same (the use of mechanisms, software or scripts in relation to the use of the Website/Randstad App is expressly prohibited as is copying using search technology such as "Robot/Crawler").
- Unauthorised or fraudulent use of the Website/Randstad App and accessing or attempting to access restricted resources of the same.
- Provoking damages to the Website/Randstad App or to the systems of Randstad or third parties.
- Reproducing or copying, distributing, allowing public access via any form of public communication, transforming or modifying the content of the Website/Randstad App.
- Including any kind of data or variations on the Website/Randstad App that infringe third-party ownership rights, are obscene, pornographic, defamatory, threatening or constitute material that may be considered criminal by virtue of the Criminal Code in force.
Users who perform these actions or any other than can harm the rights of Randstad or of third parties will be liable for any loss or damage caused.

Randstad is not responsible for and does not guarantee access to the Randstad Website/Randstad App being uninterrupted or error-free. The Website/Randstad App is placed at the disposal of Users “as is” (in the state in which it is and when it is available). Randstad is in no way responsible for failures, interruptions, faults or defects in telecommunications that may occur while the User is browsing it. Nor does it accept any liability or guarantee that the content or software that can be accessed through the Website/Randstad App is error-free. The use of the Website/Randstad App is at the sole risk of the User.
Neither Randstad nor any other party involved in the creation, production or development of the Website/Randstad App will be responsible for any kind of loss or damage, direct or indirect, or of any other kind, caused by the access to, use or examination of the Website/Randstad App or as a result of the transfer that the User may make to its equipment of any file, data, text, image, video and/or audio, contained on the Website/Randstad App which includes -without limitation- the loss of good commercial reputation, lost data, or any other loss or damage resulting from mistakes, omissions, interruptions, deleted files, errors, defects, virus, delays in operation or transmission, or any other operational failure, communications failure, theft, destruction or unauthorised access to the registries, programmes or services of Randstad.
Likewise, Randstad will not assume any liability for the losses or damages that may be suffered as a result of events that were unforeseeable, or that even if foreseeable, were unavoidable, whether fortuitous or due to force majeure.

Randstad accepts no liability for the currency and suitability of the information contained therein. Randstad makes every effort to avoid any errors in the information that may appear on the Website/Randstad App. Randstad does not guarantee, nor does it accept liability for the consequences that may arise from errors in the contents that may appear on the Website/Randstad App.
Randstad reserves the right to carry out any updates, changes and modifications it deems appropriate, and may do so at any time and without prior notice.

intellectual and industrial property
The Website/Randstad App, its source code, algorithms and its contents, including any text, data, applications, logos, trade names, trademarks and other distinctive signs, denominations, images, sounds and other resources of the same, are protected by the current regulations in force with regard to intellectual and industrial property rights, and will not be exploited, reproduced, distributed, modified, made public, assigned or transformed by third parties, unless prior written permission has been expressly granted by Randstad or, where appropriate, the owner of the rights in question. The dissemination of any content of Website/Randstad App by means of the inclusion of all or part of it on the Internet, Intranets, email or via any means, whether in written, audio-visual or digital form, even if the source is cited, is expressly prohibited, without the prior, written authorisation of Randstad.
The downloading and printing of the content of the Website/Randstad App is expressly prohibited.
Access to this Website/Randstad App does not grant the Users rights over, or any title to, the intellectual or industrial property rights of its content.
Any alteration of the content or structure of this Website/Randstad App by the User is strictly prohibited.
Randstad reserves the right to bring any legal action against Users who violate or infringe these intellectual and industrial property rights.

The Website/Randstad App may provide hyperlinks to other websites that are not owned by Randstad. In any case, this possibility does not imply the existence of a relationship between Randstad and the owners of the websites to which such hyperlinks redirect, or even the approval or acceptance of their content. The presence of these links is for information purposes only and in no case implies a suggestion, invitation or recommendation of the products, services and activities in question. Randstad will not be responsible for the legality of the content published on such websites.
The incorporation of a hyperlink to the Website/Randstad App is prohibited unless Randstad has given its express permission. In any case, such permission will imply that the hyperlink is not made in a way that harms Randstad’s public image and brand or the Website/RandstadApp itself, as well as third parties that may be referenced on it.
Randstad will remove any link as soon as it becomes aware by any means that the content of the link is unlawful or that the link harms the property or rights of a third party.

Access to transactional services and those that include the collection of personal data is carried out in a secure environment using protocols for the protection of the information disclosed. The secure server establishes a connection so that the information is transmitted in coded form. This ensures that the content transmitted is only intelligible for the user’s computer and the Randstad server. Users can verify that he/she is in a secure environment by checking that a closed padlock appears in the status bar of his/her browser. This guarantees that the client is sending his/her data to a Randstad server and not to a third party trying to pass itself off as said server.

For what purpose do we process your data?
Personal data obtained about you when you browse and use the Website/Randstad App will be processed in order to analyse how the latter are used, as well as to introduce the appropriate improvements. When data is requested for other purposes (e.g. for access as a Candidate or as a Company, or for subscribing to the newsletter and commercial communications), you will be duly informed of the applicable privacy policy in each case and the conditions of its processing in accordance with the requirements of the applicable regulations.
Randstad has adopted the necessary technical and organisational measures to guarantee the security and integrity of your data, as well as to avoid alteration, loss, unauthorised processing of or access to it.
The term for storage of your data will be the time necessary to satisfy the purpose for which it was supplied. This notwithstanding, your data will be stored, duly blocked, in order to cover any responsibilities of the Randstad Group derived from the data supplied or any other legal requirement.
What is the legitimacy for the processing of your data?
The legal basis for processing your data is the legitimate interest of Randstad to analyse the usability of the Website/Randstad App, as well as to improve the user experience.
What recipients will your data be sent to
Randstad may disclose, at the request of any body or authority with sufficient powers for this purpose, any information that allows or facilitates the identification of Users who may be involved in committing any type of administrative, criminal or conventional offence. Such information may include but is not limited to IP addresses and connection times if these are held by Randstad.
Do we perform international data transfers?
Suppliers engaged by the Randstad Group for the provision of various services may process your personal data and make international transfers of your data outside the European Economic Area (EEA) and to countries that are not subject to an adequacy decision by the European Commission; such transfers are carried out by establishing the appropriate legal frameworks.

What are your rights when you supply us your data?
Your rights set out in the legislation on personal data protection are guaranteed and you can, free of charge and whenever you see fit, exercise the rights of access, correction, erasure, restriction of processing and portability as well as the right to revoke the consent given with regard to processing, without this affecting the lawfulness of the processing based on the consent before it was withdrawn. In order to exercise any of the rights referred to, you can send the application via email to proteccion.datos@randstad.es or write to the following postal address: GRUPO Randstad - Protección de datos, Calle Vía de los Poblados nº 9, Edificio “Trianon”, Bloque B, planta 4ª, 28033, Madrid, attaching a copy of a document constituting proof of identity in either case.
If you consider that the exercise of your rights has not been properly addressed or that your data has not been processed correctly, you can send your claims to the Spanish Data Protection Agency, www.agpd.es.
In any event, at the end of the retention period or if you request cancellation, Randstad reserves the right to store your data, duly blocked, in the event it were necessary in order to comply with obligations and responsibilities imposed by mandatory laws or rules or when required to do so by an order of a competent authority in accordance with the law.

“Phishing” and other fraudulent methods of impersonation and identity theft consist of third persons passing themselves off as employees or assuming the identity of an entity by means of fraudulent use of email to obtain personal data by deceit.
We ask that you heed the following advice:
- Randstad will only communicate via email using the “…@randstad.es” format. Therefore, you should mistrust any other electronic communications sent in Randstad’s name from a domain that is different to the one indicated.
- In any case, Randstad will never ask you, by telephone or by email, for your personal access password for the Randstad employment portal. In this regard, we remind you that your username and password are personal and strictly confidential data, and should only be used for access to Randstad’s own services.
- Randstad will not ask you, by telephone or email, for a copy of your national identity document (DNI, NIE, passport), or for any information regarding your bank accounts or banking positions. You should therefore be wary if you have not previously had direct contact with the person requesting this type of data on behalf of Randstad.
- You should not access Randstad via a link, email or website that you do not fully trust.

applicable legislation and competent jurisdiction
The use of the Website/Randstad App and any legal consequences derived from the same will be governed by and interpreted in accordance with the content of this Legal Notice and any matters not expressly regulated herein will be governed by and interpreted in accordance with the applicable Spanish legislation.
Any dispute derived from the access to or use of the Website/Randstad App and its content will be submitted to the exclusive jurisdiction and competence of the Courts of Madrid (Spain), notwithstanding the applicability of any mandatory legal provision stipulating otherwise, in which case the content of the same will apply.
